We provide web hosting, domain registration, SSL certificates, & other services to our worldwide clients, and we are responsible for protecting each client and providing the best services available. All clients who use services of our are subject to the following terms of service:

Indemnification Policy:

You agree to use all our services and facilities at your own risk. We specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall we be liable for any loss or loss of data or other commercial damage, including but not limited to special, incidental, consequential, or other damages. Customer agrees that it shall defend, indemnify, save, and hold our harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable attorney’s fees asserted against us, its agents, its customers, officers, and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it’s agents, employees or assigns. Customer agrees to defend, indemnify, and hold harmless us against liabilities arising out of: Any injury, damage, or loss to a person or property caused by any products sold or otherwise distributed in connection with our server. We reserve the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by the customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from us. We shall be the sole judge of what violates this Policy.

Billing, Cancellation and Refund Policy:

If you are unhappy with our service, please contact our support department, who will attempt to rectify the situation. If the problem cannot be fixed and you are dissatisfied with the service, you are entitled to a refund within 10 Days. Refunds are only part of the 10 days.

Refunds are not available for domain names. Refunds are available for Web Hosting and SSL Certificates services provided by EncodeGarage.

No refunds will be made if we terminate your hosting or other services due to a violation of our acceptable use policy or any other violation of our Terms and Conditions, except as may be provided therein. This does not affect your statutory rights.

Credit on your account cannot be refunded and must be used for purchases and renewals.

Setup fees are non-refundable.

Free Domain Offer:

Suppose we offer a Hosting package that comes with a Free domain name. In that case, this free domain name is only for first-time registration under these circumstances: The subscription for the Professional Hosting Plan is activated annually and not canceled. The next renewal fees will be charged as standard fees & must be bear by domain name author. Free domains with .net, .com, .biz, .info, and .org extensions are renewed for 1 year period.

Delivery of Services:

Immediately upon successful payment, you will receive an automated receipt from our systems. Please print and retain a copy of this and retain it in a safe place for future reference.

Your unique customer username will be on this receipt and should be used for inquiries to EncodeGarage.

Please note that we aim to deliver all goods once signup is complete. If we cannot adhere to this, you will be informed via email, telephone, or both. Payment will be deducted when services are delivered.

The services available on this site are subject to both export and or import restrictions. Please check regulations in the country you are in to see if these products are allowed for import into your country.

Web Hosting:

These Terms of Service and Acceptable Use Policies (“Terms and Policies”) are essential to your relationship with EncodeGarage. By using your EncodeGarage account, you agree to all the Terms and Policies in this document.

General Terms and Policies:

The Service is provided to authorized persons or organizations (referred to in this document as “Subscriber” or “you”). Any use of the service is subject to any restrictions listed below. Using the Service, you agree to be bound by all these Terms and Policies. If you disagree with being bound by these Terms and Policies, you must cancel your account immediately and may not be there after use or attempt to use the Service.

Coverage: If you are an individual Subscriber, these Terms and Policies apply to all persons who gain access through your account. If you are a commercial Subscriber, these Terms and Policies apply to all your employees, agents, and customers. In either instance, a violation of these Terms and Policies by anyone using your account will be treated as a violation by you.

Prices and Charges: EncodeGarage provides the use of cPanel and domain control panels to you free of charge, but if, through misuse or abuse on your part, we incur any costs, we reserve the right to pass these charges on to you.

Term: The Service is provided to you for as long as you wish to use it. However, we withhold the right to terminate the service if you use it in a way that violates the terms of use.

Backups: EncodeGarage takes daily backups, and backups are not guaranteed. If you are using automated backup or any plugins for backup generation, you must immediately download and delete backups from your hosting account. Alternatively, you can set up remote backups using Google Drive, Dropbox, or FTP. If we discover that someone has created an automatic backup and stored the data on our server, we reserve the right to delete them without notice. If your web hosting service is suspended or terminated and you require a backup copy of your website, we will charge you $15 for that backup file if we can deliver it.

Fraudulent Payment Policy:

Suppose a payment on a client account is marked as fraudulent (such payments are reversed on the payment gateway). In that case, we reserve the full right to stop any service provided to the client (including other accounts and other payments submitted by the same client) until the issues with the payment are solved. Suppose the client refuses to solve issues with the payment, which is marked as fraudulent. In that case, we reserve the full right to delete all accounts and stop payment subscriptions provided to the client without any refund for security reasons.

Late Payment Policy:

All accounts are billed according to the dates they were first activated in the service. After the renewal date, services not renewed timely will be disabled or suspended. Suppose the services are not renewed in 5 days for web hosting after the renewal date set on the services. In that case, it will be terminated, and all files will be removed. Subscribers will receive notifications if any action is to be taken on their respectable account.

Account Access Policy:

When a client registers any account with us, the client will be held liable for the client identification information provided: a) Name and Surname of the Client, b) Client Address, c) Company details, d) e-mail address. We will assume all of this information is provided correctly and may use this information to contact the client if such a need arises. Some of the information on the account will be generated automatically (username, password, payment IDs). The client may access the account at any time if he has access to the initial e-mail account that he used to register the account on us. Suppose the client claims that he has no access to the respectable e-mail account and has no way to recover the password set on the account. In that case, he will need to provide us with the last payment date and payment IDs on which the payments were made, as well as full client name (name and surname) and full client address set on the respectable account.

Client acknowledges and accepts this procedure and access policy and agrees not to bring any claim of a lawsuit against us arising out of this said policy and procedure. We will not be held liable for any damage or liability that may have arise out of following policy and procedure.

Suppose there is more than one person claiming rights to the same account who may or have provided the information that may provide them access to the respectable account following our policy and procedures. In that case, we are not obligated to provide access to any of the parties. Also, we are not obligated to solve any kind of such disputes and may solely decide who to provide access to according to internal information and historical data that may have been collected about the user based on the usage of the respectable account.


We will not share any personal information about our clients with third parties who aren’t connected with us. Some client data may be forwarded in the following cases:

When a new domain is registered with a reputable Hosting domain registrar, client information is forwarded to the domain registry. Unless the client chooses to enable Domain Privacy in our Members Area, it may appear on WHOIS-based sites. Client information will not be displayed on WHOIS-based sites if domain privacy is enabled. However, for security concerns, it will remain on the Domain Registry. Please keep in mind domain registrations do not offer domain privacy.

Unlimited Usage Policy:

Some of our hosting packages have “Unlimited” resources for specified options (disk drive space, bandwidth, domains per account, and others pointed out on the features page). This means that we will not set a specific cap for these resources and that the client will be able to use them as needed; however, we have a fair usage policy that applies to all accounts. Our Fair Usage Policy indicates that if a client uses the shared server’s resources to the point where he is negatively affecting other users hosted on the same server, the resources may be capped or, in some cases, but not always, the respectable account may be disabled until the client upgrades his account to a package better suited to his needs or fixes the issues so that the resource usage on his account no longer negatively affects other users on the same shared server.

The term “Unlimited Space” refers to the fact that there is no limit to the number of files that a user can host on his account; however, the space on the web hosting account cannot be used for online storage, movie storage, backup storage, file sharing services, software storage, photo storage, copyrighted content storage, illegal, abusive, or offensive file backups, full account backups, file storage, document archives, website backup using plugins, any other type of archive, and these kinda pieces of stuff. We reserve the right to erase such files from the client’s account with or without warning. We also retain the right, with or without warning to the client, to remove any single file greater than 1GB from the user account, regardless of its content. We also retain the right, with or without notice to the client, to clean up a user account by removing files that come under the criteria of files that may not be contained on client accounts if there are more than 200,000 to 600,000 files, as per your package inode files limit, on a single account. We also reserve the right to deactivate any account that exceeds its package inode file limit unless the client upgrades the relevant shared hosting account to a higher plan.

Banned Scripts or website types:

The following scripts are not permitted to be uploaded or run on our servers. They are prohibited for various reasons, including negative effects on server load, invites to hackers/spammers/criminal activities, and so on. Hosting any of these sites will result of an immediate suspension of your account until the content is removed. If the client willingly uploaded the content, we reserve the right to terminate the account without a refund (even if the 30-day period has not yet expired on the account). If the content was uploaded by a third party (hackers or abusers attempting to take down the client’s site), we will notify the client of the abusive content. We additionally reserve the right to delete such content from a user’s account without notice. The following scripts and website types are prohibited:

  • IRC scripts, eggdrops, bots.
  • Proxy server scripts (any other script operating as a proxy).
  • Mail bomber and spam scripts.
  • IP spoofers and port scanners.
  • Pirated Software or any form of warez.
  • Image Hosting Scripts (like Imgur or Photobucket).
  • AutoSurf site scripts.
  • PPC site scripts.
  • PTC site scripts.
  • Bruteforce Programs or scripts.
  • File sharing, dump, and mirroring service scripts (like mega, rapidshare).
  • Top sites generator scripts.
  • Illegal drugs or other substances or products cannot be sold in the US or contraband-related sites.
  • Sites distributing copyrighted content without proper licenses
    Gambling sites.
  • Hacker programs, credit card dumps, hacker-focused sites.
  • Forums that distribute warez or other prohibited content Fraudulent sites (fake banking services, false login pages, or any other site that mines information illegally)
  • Viruses, trojan horses, bulk ping, DDoS, UDP or TCP flood programs, or other malicious scripts
  • Pornography involving children (If we discover child pornography willingly submitted to a customer account, the client account will be terminated immediately, and there will be no refund.)

Abuse identified on our servers should be reported to our official email address in the website header or footer. We will treat any report of abuse with the highest care and concern. We shall not be held liable for any harm or loss caused by content uploaded to client accounts or script activities conducted on such accounts on our shared servers. As the account owner, the client accepts full responsibility for the entire account content and all actions performed on the respectable account, and any damages or losses that may result from his account content or activities performed by scripts on his account.

Background Running Programs:

Background daemons on shared hosting accounts are generally prohibited; however, we will examine individual requests. If permitted, additional charges will be imposed based on the resources required for system maintenance. Background programs are allowed on VPS servers and do not generate any additional charges.

Commercial Advertising and Spam E-mails:

Our servers may not be the source, intermediary, or destination address involved in transmitting spam, flames, or mail bombs. Your domain may not be referenced as an originator, intermediary, or reply-to address in any of the above. SPAM /illegal content advertising sites on other servers, which contain links to a domain on our servers, is prohibited. We consider spam any mass unsolicited message in the mediums of Newsgroups and Email. If you are found to have spammed, then we will immediately, without warning, disable your domain. In addition, we will impose a $14.850 penalty for each spam policy violation. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy. As such, any violation will result in immediate deactivation of services without a refund. Server Abuse: Any attempts to undermine or cause harm to a server is strictly prohibited.

Price Increase OR Decrease:

We don’t normally change the price for running services, but if the price of software or hardware changes randomly, we use it in our services. Then, if necessary, we will increase or decrease the prices and bill any existing clients. Depending on the quality of the goods, we may or may not send you an email before any changes in our service costs.

Limitation of Liability:

We will not be liable for any claimed damages, including incidental and consequential damages, resulting from our servers going offline or becoming unavailable for any cause. Furthermore, We will not be liable for any claimed damages, including incidental or consequential damages, as a result of the corruption or deletion of any website from one of our servers. All damages must be confined to the termination of service immediately. Violations of these Acceptable Use Policies should be reported to our official email address, which may be located in the header or footer of our website. All complaints will be investigated as soon as possible.


We intend to give the best web hosting service available to each of our clients. We are primarily interested in utilizing cutting-edge technologies and solutions to deliver the best service possible to the end of the customer. However, we cannot be held responsible for any system downtime, failures, or data loss that may occur on the servers. Furthermore, we will not be held responsible for any estimated estimate of earnings that a client would have made if their site had been operational. If any terms or conditions are not followed, the account in issue may be canceled automatically by us. We reserve the right, with or without previous notice, to amend, modify, or delete any or all of the above Terms, Policies, Guidelines, and Disclaimer.
